 TERMS & CONDITIONS


1. Acceptance of Terms

By accessing our website, booking an appointment, or using any service offered by Grounded, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services or website.


2. Services Offered

We provide massage therapy, sauna, and spa services at our facility located at 78 Route One, Cumberland, Maine. All services are subject to availability and are provided by trained professionals.


3. Health Responsibility & Assumption of Risk

You acknowledge that spa and sauna services carry inherent risks, including but not limited to muscle soreness, bruising, dizziness, dehydration, heat-related illness, aggravation of pre-existing conditions, or adverse reactions. By booking a service, you voluntarily assume all such risks.


You are solely responsible for disclosing all relevant medical conditions, medications, recent surgeries, and health concerns prior to your appointment. We strongly recommend consulting your physician before using our services if you have any serious health condition.


4. Limitation of Liability

Grounded, its owners, staff, contractors, and agents shall not be liable for any injury, illness, loss, or damages of any kind arising out of or related to your use of our services or facility, to the fullest extent permitted by Maine law. This includes, but is not limited to, direct, indirect, incidental, or consequential damages.


Our total liability to you for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.


5. Right to Refuse Service

We reserve the right to refuse, modify, or discontinue services at any time, for any reason, including but not limited to health and safety concerns, inappropriate conduct, or failure to disclose a contraindicated medical condition.


6. Age Requirements

Clients must be 18 years of age or older to book and receive services independently. Clients between the ages of 12 and 17 may receive certain services with written parental or guardian consent and parent must be present in room for such services. No services are provided to clients under 12 years of age.


7. Booking & Payment

Appointments must be booked in advance. Full payment or a deposit may be required at the time of booking. By completing a booking, you agree to our Refund & Cancellation Policy outlined below.


8. Conduct & Facility Rules

Clients are expected to behave respectfully toward staff and other guests. Any form of harassment, inappropriate conduct, or violation of facility rules will result in immediate termination of service without refund and may result in being barred from future appointments.


9. Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of Grounded and may not be reproduced without written permission.


10. Governing Law

These Terms and Conditions are governed by the laws of the State of Maine. Any disputes shall be resolved in the courts of Cumberland County, Maine.


11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.

Medical Disclaimer

The services provided by Grounded are intended for relaxation and general wellness purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition or disease. Our services are not a substitute for professional medical advice, diagnosis, or treatment.


Always seek the advice of your physician or other qualified healthcare provider before beginning any wellness program, especially if you have a known medical condition.


Contraindications — Please Read Before Booking


Spa and sauna services may not be appropriate for everyone. Please consult your doctor before booking if you have any of the following:

  • Heart disease or cardiovascular conditions
  • High or low blood pressure
  • Pregnancy or suspected pregnancy
  • Diabetes (Type 1 or Type 2)
  • Active skin infections, rashes, or open wounds
  • Recent surgery or injury (within 6 weeks)
  • Epilepsy or seizure disorders
  • Cancer or are currently undergoing chemotherapy/radiation
  • Fever, illness, or communicable conditions
  • Blood clots or risk of deep vein thrombosis
  • Use of blood thinners or photosensitizing medications

Sauna-Specific Safety


Sauna use involves exposure to high heat and humidity. To use our sauna safely:

  • Stay hydrated — drink water before, during, and after your session
  • Do not use the sauna under the influence of alcohol or drugs
  • Limit sessions to the recommended time posted in the sauna room
  • Exit immediately if you feel dizzy, lightheaded, or unwell
  • Allow adequate cool-down time between sessions

Assumption of Risk


By using our services, you acknowledge that you have read and understood these health and safety guidelines, that you have disclosed all relevant medical information to our staff, and that you voluntarily assume all risks associated with our services.

We may collect the following information when you book an appointment, fill out an intake form, or contact us:

  • Date of birth and emergency contact information
  • Health intake information including medical history and medications
  • Payment information (processed securely through our payment provider)

We use your information solely to:

  • Contact you regarding your appointment
  • Ensure your health and safety during services

3. Health Information

Health intake information you provide is collected for the sole purpose of ensuring your safety during your visit. This information is kept strictly confidential and is not shared with third parties except as required by law.


4. Data Sharing

We do not sell, rent, or trade your personal information. We may share information with trusted service providers (such as payment processors or scheduling software) only as necessary to operate our business, and only under agreements requiring them to protect your data.


5. Data Retention

Client records, including health intake forms and signed waivers, are retained for a minimum of 7 years in accordance with Maine state requirements. You may request deletion of non-legally-required data at any time by contacting us.


6. Data Security

We take reasonable steps to protect your personal information from unauthorized access, disclosure, or loss. However, no method of data transmission or storage is 100% secure. We cannot guarantee absolute security.


7. Cookies

REFUND & CANCELLATION POLICY


Cancellation Notice


We require a minimum of 24 hours notice for all cancellations or rescheduling requests. This allows us to offer your appointment time to other clients.

To cancel or reschedule, please contact us at 207-671-3179 or groundedmaine@gmail.com at least 24 hours before your scheduled appointment.


Late Cancellations

Cancellations made less than 24 hours before your appointment will be subject to a cancellation fee of 50% of the booked service value.


No-Shows

Clients who do not show up for their appointment without prior notice will be charged 100% of the booked service value. Repeated no-shows may result in a requirement to prepay for future bookings.


Deposits

A deposit of 50% may be required at the time of booking for certain services or for new clients. Deposits are non-refundable if the appointment is cancelled within 24 hours or in the event of a no-show.


Refunds

Refunds for services already rendered are not provided. If you experience a problem with a service, please notify us immediately so we can address it. We may offer a complimentary follow-up service at our discretion.

Prepaid packages and gift cards are non-refundable and offer no cash value but may be transferred to another person or applied to a different service.


Late Arrivals

If you arrive late for your appointment, your session may be shortened to accommodate the next scheduled client. You will still be charged the full service price. We recommend arriving 10 minutes before your scheduled appointment time.


Illness Policy

If you are feeling unwell, have a fever, or have been exposed to a contagious illness, we ask that you reschedule your appointment. In these cases, we will waive the late cancellation fee with notice given as soon as possible. Please do not come to your appointment if you are sick, as this protects both our staff and other clients.


Exceptions

We understand that emergencies happen. Cancellation fees may be waived at management's discretion in the case of a documented medical emergency or other extenuating circumstances.
